Preparing for an Audit
Each committee's campaign activity may be subject to audit by the Ethics Commission, the FPPC or the Franchise Tax Board. Audits are conducted to determine whether candidates and committees have complied with applicable requirements and prohibitions imposed by State and local law. The Ethics Commission randomly selects candidates and committees for audit. Local law requires the Ethics Commission to audit all candidates who receive public funds.
Fines
Any person who violates any of the reporting requirements or contribution or expenditure limitations, including both paper and electronic reporting requirements, set forth in state or local law, may be subject to fines, penalties and/or imprisonment. Fines vary depending on the violation but potentially are significant—and can be as much as three times the amount of money received or spent in excess of legal limits. In addition to any other penalties that may be imposed, late fees for filing any copy of a statement or report filed after the deadline are $10 per day for paper filings, limited to the amount of activity during the reporting period or $100, whichever is greater. In addition, there is a $25 per day fee for electronic statements or reports filed after the deadline, limited to the amount of activity during the reporting period or $250, whichever is greater.

Contributions Received by Committees
On September 20, 2007, Judge Jeffrey White of the United States District Court for the Northern District of California issued a preliminary injunction prohibiting the enforcement of Campaign and Governmental Conduct Code section 1.114(c)(1) and 1.114(c)(2) and Ethics Commission Regulation 1.114-2. The law has not been repealed, and the case is ongoing, but in accordance with the court's order the City currently is not enforcing the contribution limit set forth in those sections. We will report any further developments in the case on this site.
